Realtor® Legal Tip – Do you disclose the final sales price data of your listings to third party websites other than the local MLS?

One thing to remember is that if you use the standard UAR listing agreement, the listing agent may only disclose the final sales price to the MLS he/she participates in. Likewise, if you represent a buyer, the Exclusive Buyer Broker agreement only authorizes disclosure to the MLS you participate in. Disclosing sold data to third party websites other than the local MLS you participate in may be a breach of these agreements and/or a breach of the duty of confidentiality you owe the client.
*Note – If your brokerage uses a different listing contract form that has additional or different authorizations with respect to disclosure of final sales price information, be sure to be in compliance with the terms of that specific agreement.
